A Symposium on the Notwithstanding Clause Appeals
Contributors will react to the hearing in the Quebec case
In my introductory post for the Monitor, I indicated that it might grow over time to embrace occasional posts from guest contributors and symposia. I am happy to announce that this time has now come.
The first symposium will be on the Canadian notwithstanding clause appeals that are being heard by the Supreme Court of Canada in the coming months. The hearing in the Quebec case starts on Monday and is scheduled for March 23-26, 2026. The symposium will feature reactions from scholars and theorists to issues raised during the hearing, and will occur prior to the hearing of the Saskatchewan case.

The contributors will have a month to reflect on the issues raised during the hearing and posts will begin in late April or early May. For readers unfamiliar with the cases, there will be an introductory post to the symposium highlighting the salient details. Stay tuned!
